Acceptance of terms
By downloading, installing or using Oryx DMS ("the App"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the App.
These Terms apply to all versions of the App available on iPhone, iPad and Mac through the Apple App Store.
License to use
Saad Rodriguez grants you a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal or internal business purposes, subject to these Terms and the Apple App Store Terms of Service.
This licence does not allow you to:
- Copy, modify, or distribute the App or any part of it.
- Reverse-engineer, decompile, or disassemble the App.
- Use the App for any unlawful purpose.
- Remove or alter any proprietary notices on the App.
- Transfer the licence to another person or entity.
Apple App Store
The App is distributed through the Apple App Store. Your use is also subject to Apple's Standard End User Licence Agreement (EULA), which is incorporated into these Terms by reference. Apple has no obligation to provide support or maintenance for the App.
Your content
You retain full ownership of all documents, contacts, and other content you store in Oryx ("Your Content"). We do not claim any rights over Your Content.
You are solely responsible for ensuring that Your Content:
- Does not infringe any third-party intellectual property rights.
- Does not contain unlawful material.
- Complies with any applicable regulations, including data protection laws, if you store personal data about other individuals.
iCloud and data storage
Oryx uses Apple's iCloud and CloudKit services to sync your data across your devices. Use of iCloud is governed by Apple's own Terms of Service and Privacy Policy. We are not responsible for any loss, inaccessibility or corruption of data caused by Apple's services or your iCloud account settings.
We strongly recommend enabling iCloud sync as your primary backup strategy. We are not liable for data loss caused by device failure, accidental deletion, or any other cause.
Permitted use
The App may be used for personal, professional, and internal business document management. You must not use the App to:
- Store, distribute or process illegal content of any kind.
- Circumvent any security or authentication measure.
- Attempt to gain unauthorised access to any system or network.
- Interfere with the operation of the App or related services.
Intellectual property
The App, including its design, code, graphics, name and all associated content (excluding Your Content), is the exclusive property of Saad Rodriguez and is protected by copyright, trademark and other applicable laws. The name "Oryx DMS" and the Oryx logo are proprietary to Saad Rodriguez.
Disclaimer of warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy or completeness of any content generated by the App (including OCR output).
Limitation of liability
To the maximum extent permitted by applicable law, Saad Rodriguez shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of business, arising out of or in connection with your use of the App, even if advised of the possibility of such damages.
Our total liability for any claim arising under these Terms shall not exceed the amount you paid for the App.
Updates and availability
We may release updates to the App at any time. We reserve the right to modify or discontinue the App (or any part of it) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension or discontinuance of the App.
Termination
These Terms remain in effect until terminated. Your rights under these Terms terminate automatically if you fail to comply with any of their provisions. Upon termination, you must stop using the App and delete all copies from your devices.
Governing law
These Terms are governed by and construed in accordance with the laws of Spain, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Spain.
Changes to these terms
We may update these Terms from time to time. Material changes will be notified via an in-app notice or by updating the date at the top of this page. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
